SUBJECT: HIPAA Security and Privacy v2.0 – In the Age of the HITECH Act
The federal Office of Civil Rights recently launched its pilot program to start auditing covered
entity provider organizations. This is a considerable change in policy - from the original
HIPAA compliant-based investigation approach to a more aggressive way of ensuring industrywide
HIPAA privacy and security compliance. With the advent of the American Reinvestment
and Recovery Act and specifically the Health Information Technology for Economic and
Clinical Health (HITECH) components, both the requirements and enforcement have changed
considerably requiring new and adjustments to old policies and procedures. HIPAA and
HITECH issues raise not only compliance and legal concerns, but also business costs and public
relations and reputational concerns. The purpose of this program is to provide a HIPAA privacy
and security overview with a special focus on the new changes and challenges that are a direct
result of the HITECH Act.
